what kind of leafy evergreen do i have

I'm in southwester ontario,
Me and my wife bought a house last fall and this tree was there, it kept it's leaves all year. could anybody help me identify it?

The plant in question is growing in New York state, so not far away from you. I can't tell from the photos whether the plants are identical or not.
