Can you identify these flies? They're destroying my herbs!

Hi all,
I have a crazy fly infestation and suspect they are causing my herbs to die. I have taken some close up photos of them (that is a styrofoam container, and the other container I'm using is plastic) and hope that an expert in this forum can identify the offender! The leaves of the basil and mint are blackening and many have fallen off, and the flat leaf parsley seems to have some brown spots on the tips. The only herb which doesn't seem to have been touched is the chive! I am a beginner and would very much appreciate any advice you can offer!

can you give us a better idea of how big these nasty looking guys are?

They are really tiny... probably not more than 3 millimeters in body length. In the photos, they are sitting on ordinary styrofoam (it's just magnified quite a bit).
