The leaves and stem have a large amounts of Black spots on them, similar to black spot that roses get.
It may have been planted badly... Would a spray be able to take care of it do you think? Would replanting and a small prune help?

My suggestion would be to investigate fungus problems - often caused by excessive moisture around the roots - and consult a garden supply vendor for a proper fungicide. Look up the species online and pursue pests and diseases.
Many fungi are rarely lethal (however distressing in appearance) but can often be combated with proper maintenance and and appropriate application of medication.
