You don't think it's a rhododendron?

No, hasn't bloomed yet, it gets small white flowers and If IIRC it gets little black olive looking berries., its definitely not Rhododendron.

What do the leaves smell like. California bay has a bay leaf scent and small white flowers.

No smell as far as I can recall, will check tonight., I'm thinking it may be Cherry Laurel.

Sounds like a possibility. I have had California bay laurel for years but it may be my climate, the tree has had small flowers but I don't remember seeing berries.

It looks like the laurels we have planted, which are English Laurels.
